It is solely dependent on the content reading (how much above 0.08%?)

Does every casualty case get pulled out by IRS, as soon as you file it? Or some go unnoticed?

What does the Tax court involve? Cost and Duration?

It's obviously possible. You read the Tax Court opinion.

It's dependent on the totality of the facts: was he negligent? While the blood alcohol level was a factor, it clearly was not the only factor. Would it have made a difference to the Tax Court if it was 0.10? 0.16%? Who knows. It was 0.09% and no other levels were relevant.

Not every casualty loss case gets pulled. The IRS doesn't pull 100% of any single area. The bigger it is, the more noticeable it is.

File a petition, try the case. The cost depends. Pro se? Little cost. Have an attorney? Big cost but perhaps a better chance of making a telling argument and winning your case.
